Summary:
This paper addresses the interpretation and application of the ne bis in idem principle
to administrative disputes, inter alia smuggling, resulting from the imposition of
administrative sanctions. At first, a brief account is given on the development of the
same principle under various provisions of european, international, american and
greek law. The research is not meant to be comprehensive; it aims rather to highlight
judges’ source of inspiration. The discussion then moves on the "points of friction"
both of the European Court of Human Rights and the Hellenic Council of State caselaw.
In this context, a considerable amount of space is given to their converging and
divergent positions. Τhe impact of the European Court of Justice on the abovementioned
judicial dialogue is further presented on an ad hoc basis. Finally, useful
conclusions are being drawn about the appropriate solutions.
