The freedom of art - An unconditional, but not unlimited right
Summary:
The special reference to the freedom of art in Article 16 (1) of the Constitution in relation to other forms of expression demonstrates its increased enshrinement, apparently inspired by the German Fundamental Law of Bonn. But what is art and how is it protected? This study first focuses on the vague concept of art and a historical overview of its constitutional vesting. This review as well as the international enshrinement reveal the great importance of Article 16 (1) of the Constitution, establishing the unconditional freedom of art. Unconditional freedom of art, however, does not mean unlimited. When freedom of art conflicts with other constitutionally protected goods, restrictions can and must be imposed with the necessary balance of conflicting interests. Art is not restricted because there can not be an unlimited freedom, but to ensure the unity of the Constitution. By analyzing the basic jurisprudence on the conflict of art with other constitutionally protected goods it can be seen that in Greek practice the boundaries are sometimes controversial and when a work of art exceeds a minimum of tolerance, it is against the freedom of the art to protect other legitimate good. Therefore, the issue of restrictions on artistic creation is primarily a matter of culture and tolerance, and not legal, and the principle in dubio pro Arte should be accepted...
