Issues of Multimodal and Successive Transport: the Assessement of the Network System
Summary:
The core problem of the multimodal transport is the liability of the multimodal transport operator, also known as "MTO". The rapid technological development of the international multimodal transport was not accompanied by the necessary specific and uniform regulation. The thesis presents the issues of multimodal transport, the international efforts, made to establish a unified legal framework, the systems of the MTO's liability, born out of theory and finally the conflict caused by the adoption of the "network system" between the mandatory law provisions of the various International Conventions on Carriage of Goods and the standard commercial terms and how the case law dealt with this conflict.
