Summary:
One of the problems that emerged from the financial crisis that has plagued Greece over the last few years is that of non-performing loans. The lack of liquidity and capital adequacy with which the greek credit institutions were confronted, motivated the legislator to draw up a specific legislative framework in order to face the problem of non-performing loans through the assignment of the management and the sale of claims to third parties. It is about law 4354/2015. This thesis discusses the issues related to the above law, unfolds its basic settings and seeks to emphasize the way that well-known institutions of civil law, such as sale and assignment, are being used by the legislator to deal with the problem of non-performing loans, presenting at the same time deviations from the provisions of the Civil Code. Reference is made among others to the related institution of securitization of claims, while in the last chapter the thesis focuses on the crucial issue of protecting the debtor of the transferring claims.
