Summary:
The present thesis addresses the compensation issue on the occasion that the debtor has been imposed with unjust enforcement proceedings. The first part explores the historical background concerning the provision of article 940 of the Greek Code of Civil Procedure, the reasons for its effect, and the second part elaborates on the prerequisites for its application. Furthermore, the interpretations of cases 49/2005, 12/2009, 9/2010 before the full bench of the Supreme Court (Areios Pagos), as well as the contradictory scopes maintained in theory, are examined according to the recent case law in the matter of compensation which is specifically stipulated in the article 940§3 of the Code of Civil Procedure.
