Summary:
The European Court of Human Rights (ECHR) has both the power to issue decisions and impose measures at a European level, a competence which is recognized voluntarily and in good faith by the European states that are the members of the ECHR and who are members of the Council of Europe. The existence of such a body, which safeguards the rights of citizens residing in European states, is considered to be of the utmost importance in safeguarding their rights and further strengthening of the democratic institutions in Europe, leading towards the long-term goal of further integration and cooperation for common progress and development of the European States. This study focuses on one of the means to achieve the above objectives, assessing the success of the ECtHR in ensuring freedom of expression (Article 10 of the ECHR) and the assembly and association (Article 11 of the ECHR) by securing citizens in the democratic process, active and passive participation in the elections (Article 3 of the First Additional Protocol to the ECHR), by focusing on the political parties.
