Summary:
A significant part of the economic losses suffered by the recipients of banking and investment services is due to the action of credit institutions and investment firms themselves. Besides, the recent financial crisis has made the demand for protection of the usually inexperienced with the new financial products counterparties of these financial institutions even more intense and has made them seek compensation for their losses. Moreover, Article 8 of the Law 2251/1994 regulates the liability of suppliers of services providing that the injured consumer does not have to prove the elements of illegality and fault of the provider of defective services, as they are presumed. Therefore, the question arises whether the provisions of Article 8 of the Law 2251/1994 can offer the counterparties of banks and investment firms effective protection, even helping them to overcome difficulties posed by the Greek Civil Law. So, the subject of this thesis is the liability of credit institutions and investment firms for the provision of faulty services on the basis of Article 8 of the Law 2251/1994.
