Summary:
Directive 2011/92 (as subsequently amended by Directive 2014/52) codifies the provisions for environmental impact assessments, procedures that should preceed any administrative permit for the construction or functioning of works that have or might have serious effects on the environment. The paper presents the Directive's adoption by the Member-States, especially given their differing traditions in administrative law and judicial protection. These differences are highlighted, although they to not seem to lead to significant varations in the level of substantive and judicial protection.
