The selective distribution agreements under the European Competition Law
Summary:
In this present thesis an analysis of the function as well as the judicial stand on selective distribution agreements under the light of European Competition Law, is attempted. The conditions, under which a selective distribution system is considered legal and compatible with the rules of Competition Law, are thoroughly explained and furthermore, the revulsion from a per se formalistic perspective to a more economic approach is underlined emphatically. In addition, the statute of block exemption is addressed in reference to the Union' s system of workable and effective competition.
