THE POWERS OF THE NATIONAL COMPETITION AUTHORITIES IN THE LIGHT OF EUROPEAN COMMISSION'S ECN+ PROPOSAL FOR A DIRECTIVE COM (2017) 142 FINAL

The subject of this present thesis is the powers of the national competition authorities (NCAs) in the light of European Commission's ECN+ proposal for a directive, hereafter the ECN+ Proposal. Moreover, the purpose of this thesis is to compare the provisions of the ECN+ Proposal to the Greek Competition Law, especially the Act 3959/2011 “on the Protection of Free Competition”.
This thesis consists of two chapters of which the first one concerns the present legal framework of the implementation of the rules on competition, according to Regulation (EC) No 1/2003, including an historic account of the issue. Whereas, the second chapter presents a comparative analysis of the ECN+ Proposal and the Act 3959/2011. In particular, this comparison refers to independence, resources and prioritization in the specific case of the enforcement of Articles 101 and 102 TFEU by the NCAs. Additionally, this thesis makes reference to the powers of NCAs to investigate, take decisions and fine companies which breach competition law. Finally, this study also reports issues relating to limitation period for bringing proceedings, leniency programmes and mutual assistance between NCAs.
