Private Divorces Between Intertextual Law and Union Private International Law
Summary:
In the present study, we will investigate the "unilateral" Islamic divorces in the various substantive laws, such as in Greek, including interpersonal law. Ιn particular, "private divorces" will be analyzed , with emphasis on the “talaq”, within the framework of Union Law, in particular the provisions of Regulations 1259/2010 (Rome III) and 2201/2003 (Brussels IIa).Lastly, apart from the legality and "constitutionality" of private divorces, the impact on some of the classical imperatives of Islamic law with European and national public order is examined
