Employee participation and the position of specially protected employees in the process of collective redundancies

Employee involvement is the "pivotal axis" of the protection afforded by Directive 98/59/EC and Law 1387/83 to employees in the case of collective redundancies. Using the recent reform of the process through Law 4472/2017 as a starting point, this thesis attempts to systematically examine the core elements of the process, the respective obligations and rights of the parties involved, as well as the practical issues that arise, with particular emphasis on the "evergreen" and problematic system of employee representation according to Art. 4 of Law 1387/83. Moreover, on the basis of recent case-law of the European Court of Justice, this thesis examines the way individual protection afforded to some special categories of workers interact with the collective process provided by Law 1387/83.
