ELECTRICITY CONSUMER PROTECTION: FACTS AND CHALLENGES WITHIN THE FREE MARKET

In the context of this study, the issue of consumer electricity protection has been gathered in a comparative overview of the supplier's (non-demonstrative) general terms and conditions in the retail electricity supply market to small customers, that is to say - to household customers and non- household customers with a payload of up to 25 kVA. Through the survey, it was noted that, despite the provisions of the law, there are general terms and conditions within the contracts that are worrying as to whether they are in compliance with the law concern, as well as to whether they are in line with the principle of transparency. These general terms and conditions are attempting to be systematised in this study (condition regarding the amount of the guarantee paid, the term of the unilateral amendment of the terms of the contract by the supplier, the variable charge clause, the CO2 clause) and comment, on whether they are in line with its forecasts law and are therefore valid or not, but also with regard to their possible abusive and thus invalidation. In addition, the present study also deals with the question of mandatory contracts in the electricity market, with emphasis on the issue of suppliers' negative contractual freedom.
