Translated title:
Antiterrorist legislation, Historical dimensions - Legislation in force - Case law
Summary:
The subject of this paper is the study and analysis of counter-terrorism greek legislation. The comprehensive and coherent perception of this issue dictates the necessity of prior recording of the historical dimensions of the phenomenon of terrorism and its
consequent treatment as criminal offense. The starting point, however, of this paper is to illustrate the aims of the Criminal Law and the special treatment it holds for political crime, an effort necessary in order to find the justifiable reason for introducing an independent criminalization of an already criminal behavior as a terrorist act. Finally, reference is made to the Greek judicial response to the phenomenon of terrorism, starting with the 17N case and continuing with the trials of the so-called "younger generation of terrorists", with reference to more specific legal issues these trials were called upon to address.
