Summary:
This thesis examines the place of refuge problem and the issue of state liability for pollution damage caused by incidents involving places of refuge.
In the first part of the thesis, an attempt is made to clarify whether ships in distress enjoy a right to seek and obtain shelter in coastal states’ ports under customary and conventional international maritime law. Contemporary international and regional responses to the issue of places of refuge are also considered.
The second part of the thesis attempts to determine to what extent a coastal state can be held liable vis-à-vis other states and individuals for pollution damage caused by ships in distress, whether access to a place of refuge was granted or not.
