Summary:
The purpose of this paper is to present the legal status of the liability of actual carriers, ie third parties who undertake to carry out part or all of a sea or land transport, through a comparative analysis of the two systems of responsibility in maritime and inland transport respectively. It further analyzes the legislative gap in the Hague-Visby rules with regard to the protection of actual carriers and clarifies the exonerating clauses that are often provided for the latter. The position of Greek and European Courts on the issue of the liability of actual carriers to maritime transport is presented, and finally, the filling of the legislative gap with the introduction of the Rotterdam rules, which first envisages the concept of maritime executing parties and the regulatory framework for their responsibility and protection.
