Summary:
The objective of this study is to examine the opportunity given to shareholders to bring reflective loss claims before international investment tribunals. Following the definition of reflective loss and a brief reference to the legal framework in domestic legal systems and general international law, the arguments of critics of reflective loss claims in international investment arbitration are presented. In the last and most significant section of this thesis, there are proposed solutions regarding the contingent problems arising out of reflective loss claims brought by shareholders; emphasis is given in the selection of the appropriate method for the valuation of damages by the arbitral tribunal.
