Summary:
State’s regulatory intervention in the electricity sector often takes the form of mandatory rules, exemplifying the imposition of regulated charges on electricity bills in the public interest. Regulated charges include public utility bills, system usage charges, network usage charges, and a Special Fee for Gaseous Emissions, and are a significant part of the electricity bills, which are characterized as non flexible.
Of course, the State's choice to impose regulated charges is based on the directives of the European Union, transposed into national law and specified by regulatory acts of the states and their bodies, such as the Regulatory Authority for Energy. The objective of this paper is to provide a comprehensive analysis of the legal nature of regulated charges as addressedeva of legal theory and case-law.
