EU's preliminary reference, a procedure which has been of fundamental importance to the success of the European experiment, is the model on which ECHR's advisory competence was organized. The two mechanisms share the same goal, the uniform application of the law, and have important similarities, but they also differ in key aspects. The present paper compares them to highlight their similarities and differences
