Η δικονομική προστασία των αλλοδαπών υπό το πρίσμα της ΕΣΔΑ
Translated title:
The procedural protection of foreigners in the light of the ECHR
Summary:
The protection of human rights provided by the ECHR is a very important part of this protection for all countries that have acceded to the Convention. Among the rights protected are the ECHR and procedural safeguards, which are reflected in both the Covenant on Civil and Political Rights and many national laws. The subject of this work, however, is the procedural protection for aliens. Particularly in recent years, with the refugee crisis and its consequences for Greece, it is very interesting to discuss the issue of procedural protection for these individuals, who often find themselves in a vulnerable position and fail to respond when attempting to have access to proceedings in the country where they reside.
In this work, there is initially a more theoretical background to the notions of aliens and their categories, but also to the articles of the ECHR applicable to the field of procedural protection and their case law. The second part is therefore devoted to the application of this protection in Greece, related cases and the impact of the ECHR on national legislation.
