The use of armed guards on vessels: legal consequences for ships' operating contracts and third parties' damages
Summary:
This dissertation presents research on cases when shipping companies are forced to use armed guards in order to deal with piracy and robbery against ships. In particular, efforts are being made to identify the legal consequences of such use for the ship's operators as well as for third parties .who sustained damage. Under the framework of the research BIMCO standard contract "Guardcon" as well as Greek Law 4058/2012 were studied in detail. Legal characterization of armed guards is also being made in accordance with the Greek legal system, while in the end there is a brief overview of the recent Enrica Lexie case.
