Summary:
This thesis explores the legal nature of a refinancing agreement according to Greek case law. Due to the absence of a clear legislative definition of refinancing in Greek law, the thesis firstly defines refinancing as prescribed under the provisions of the supervisory legislation. Thereafter, the thesis analyzes the criteria for classification of a loan between “forborne exposures” and “non-performing exposures”, depending on the degree of credit risk of the claim arising from that loan. Thus, the thesis highlights the legal treatment of refinancing in the light of the provisions of supervisory legislation. The thesis analyzes, afterwards, how a refinancing agreement could be considered under the Greek law as a renewal contract or a compromise, as well as the consequences of either solution on the collateral of the initial agreement and, in particular, on the extent of the guarantor’s liability. Finally, the thesis presents another form of refinancing, namely further transferring claims arising from loans and credits as provided for in Law 4354/2015. This form of refinancing has – as has already been expressed in legal theory – the legal nature of a renewal contract.
