Summary:
The protection of cultural heritage should be a common concern for all mankind. War and other forms of armed conflicts are one of the greatest threats to the whole cultural heritage, and therefore the international legal framework for the protection of cultural heritage should be a separate matter of research and legal interest, and will always be a matter of concern and a timely issue. In this thesis, there is made an attempt to list the regulatory status of cultural heritage protection during armed conflicts, as it has been shaped during the historical events. With this dissertation try to provide historical events of the 18th and 19th century to date, to reflect the transition from a period of non-existent legal rules on the subject, to the first serious recording and codification of rules and their evolution into the current legal system. We first attempt to identify and interpret the multiple concept of the subject. Hence, the thesis is structured in three parts, starting from the reference to the specific legislative framework during wartime, moving to the general protective regime governing the peace period and concluding by applying the above to the specific case of Syria (as a case study).
It is therefore concluded that, although there is a significant number of legislative texts, the legal instruments available have proved ineffective in protecting cultural heritage in times of conflict. Therefore, we come to the following considerations: either the legislation has not been effective enough, or the law enforcement (both the state and non-state), have shown little concern for its proper implementation.
