Summary:
The subject of this study is the conduct of arbitral proceedings in international arbitration, as regulated in the Greek legal system by law 2735/1999. The main focus lays on the wide freedom of the parties (and the arbitrators as well when there is not such agreement) regarding the determination of the rules of procedure, which includes the choice of place, language, hearings and evidence. Issues such as the commencement of arbitral proceedings and the content of claim and defense are also included. The importance of equal treatment of the parties and their opportunity to fully present their case is highlighted throughout the analysis of their freedom (or that of the tribunal) to lay laws of procedure. The analysis of the above issues is accompanied by a comparative view of the provisions of the Code of Civil Procedure regarding national arbitration, and the possibility of them being applied to fill gaps of the law for international arbitration and vice versa.
