Equality in EU legal order: from an economic tool to a new EU policy
Summary:
The functioning and the role of equality have evolved in EU legal order. Equality was primarily a tool for economic integration and has now evolved into a new autonomous EU policy in order to achieve fundamental EU goals. Its main purpose is to ensure the effective implementation of equality in EU actions and measures by achieving the similar treatment of similar situations. The principle of equality applies horizontally in the Union's relations with the subjects of EU legal order, i.e. with Member States and private individuals (natural and legal persons) and has as a result led to the creation of a new and autonomous EU policy for equality. The obligation of the EU institutions to treat Member States equally, and to respect the equality of individuals, as a general principle and right under EU law, plays a pivotal role.
