The supply of judicial protection under the provisions of articles 94 and 95 of the Constitution
Summary:
The supply of judicial protection is stipulated in the article 20 of the constitution. The manner of the supply of the judicial protection is defined in the procedural provisions of the constitution, especially in articles 94 and 95. Due to these provisions the research examines matters relevant to the efficient and speedy supply of judicial protection under the system of the separate jurisdiction between the civil and administrative courts. The research also examines the potential of a transfer of cases of voluntary jurisdiction from the civil courts to the administration and the administrative courts. Furthermore the research sets a question about the potential adoption of a unified jurisdiction system between the civil and the administrative courts. There is a proposal about the unification of the jurisdiction between the administrative courts and the Council of State, the supreme administrative court, via constitutional reform. For that purpose, there is a proposal for the introduction of a common legal remedy in the administrative procedure under the title “application of judicial review”
