Summary:
The subject of the dissertation is the investigation of the autonomy of sport and, in particular, the autonomy of sports legal entities, and further in this respect, the investigation of the structure, organization and special features of legal order in the area of sports. Within this context, the structure, organization and special features of the state legal order, which is formed by the state authority, together with the sports legal order, which is formed by the private initiative, and the legal form and the special characteristics of sports legal entities, which contribute to the formation of such sports legal order, are presented. In addition, the relationship between the autonomy of sport and the private autonomy, the freedom of contract and the freedom of association is evaluated and analyzed; the particular nature of autonomy of sport is outlined and the formation of sports legal order based on autonomy of sport is investigated. Also, there is a detailed, typological presentation of the limitations imposed on the autonomy of sport by the state legal order, emphasizing on the fundamental distinction between compulsory law and public order, and by the sports legal order. In the context of this development, the key issues of testing the private autonomy of the parties contracting with the olympic committees and the sports federations are also examined and some more specific issues raised by the contradictions between the limitations of the autonomy of sport by the state legal order and by the sports legal order, are also detailed.
