Summary:
Organ trafficking constitutes a complex criminal phenomenon that affects a significant number of countries worldwide, without, however, any knowledge of its true extent, due to lack of available statistical data that depict the current situation. Common factor is, usually, the exploitation of the donor's despair (who sells his organ due to his financial destitute) as well as that of the recipient (who searches for a graft due to his serious health problems) by organized crime groups, willing to find human organs for an excessive fee. Members of such groups are mediators, doctors, nurses, border guards, etc, in order for the organ acquisition and the consequent illegal transplant to take place without any problems. Aim of the present study is the criminological approach of the organ trafficking crime, as well as that of the modus operandi of a relevant organized crime group. Furthermore, the present study analyzes the interactive parameters of organ trafficking, transplant as a medical act and organ donation. At the same time, the opt-out system, as introduced through Law 3984/2011, is being examined, as well as the disposition of civilians towards it, especially after the social reactions provoked by its rigid implementation, without any previous public information campaign.
