Summary:
The enforced disappearance constitutes a method which historically began by
nazist regime in Germany and is specially widespread in Latin America because of
the dictatorial regimes of the area which dominated in the 1970s and used this method
for threatening the political opponents.Additionally, the majority of the cases in
Europe has mostly to do with conflicts, such as the Russian invasion in Chechnya and
the continuing intense situation in the southeast region of Turkey between the State’s
officials and the Kurdish population. So, it is very important to look into the enforced
disappearance cases’ handling because it is a phenomenon which continues to be
applied in the European and American continent and it, also, transforms into various
permutations when it comes to its execution. The jurisprudence of both Courts on this
subject should be analyzed so that an adapted and improved approach could be
mooted in the future by taking into consideration the corresponding data.
