Summary:
The relationship between EU competition law and environmental protection is a long-discussed topic. Currently this topic is at the forefront of competition policy discussions due to the urgency of climate change and the current COVID-19 pandemic. Many people support the belief that private business initiatives are an important tool for the transition to a green economy that will complement the relevant regulation. This paper examines the interaction of competition law and environmental protection during the application of the lato sensu competition rules. Initially, the assessment of environmental factors in light of the rules of free movement within the EU is presented, correlating the conclusions with the field of competition law. The main object of the paper is the examination of environmental agreements, namely agreements aimed at achieving environmental objectives, under Article 101 TFEU, which prohibits cooperation between competing undertakings (paragraph 1). In particular, the assessment carried out pursuant to paragraph 3 of the Article is analyzed in detail in order to classify environmental agreements which have been found to be restrictive of competition as compatible or incompatible with competition law. Furthermore, the correlation of environmental factors with Article 102 TFEU, which prohibits the abuse of a dominant position, and the European Merger Regime are presented. Finally, the approach of state aid rules in relation to environmental objectives is examined and a comparative overview of the above and the approach of stricto sensu competition rules takes place.
