Summary:
The present study deals with the systematic and historical interpretation of the ban on party events of court officials, based on article 29§3 ed. a) of the current Constitution. On this basis, the study attempts the interpretive approach of the relevant provisions of the Code of Organization of Courts and the Status of Judicial Officers and mainly of article 91§4 par. b), checking the agreement of the statutory matters that limit the right of judicial officials to express themselves with the constitutional regulations. In addition, the study includes a comparative study of the conditions for the public expression of the opinion of judicial officials in accordance with the ECHR and the regulations of European legislation. As it can be concluded, a narrow interpretation of the investigated ban is required, which applies to political parties that have been established under the terms of Law 3023/2002 and may not be extended to other forms of aggregation, such as trade unions. At the same time, from the interpretative approach of the ECHR to the protection of the free expression of opinion according to article 10§1 of the ECHR, a peculiar right of judicial officials also emerges in political speech. A right determined through two well-known criteria of the case law of the ECtHR: the restraint of judicial officers during their out-of-office expression and the risk of being prevented from participating in public debate.
