Summary:
This paper deals with and studies the common European asylum system and presents its legislative development, through an analysis that is divided into three parts and essentially refers to the period from 2015 onwards. In particular, the first part presents the current regime and further analyzes some problems that arose from its implementation especially during the immigration crisis of 2015 and focuses more on the problematic around the Dublin system. The second part analyzes the reforms proposed by the European Commission in 2016 in an effort to restructure the CESA, while at the same time presents alternative perspectives that were proposed in response to these reforms and the obstacles that ultimately did not lead to the adoption of the proposals. Finally, the third part concerns the analysis of the "New Pact on Immigration and Asylum" published by the Commission in September 2020. This New Pact contains a series of legislative pieces, with which the Commission states that wants to set a new course, make a fresh start and correct the problems of the past. The legislation and the objectives set by the Commission are currently being analyzed and it remains to see whether they will eventually be voted on.
