Triangular relationships: the agreement of borrowing/ loaning an employee, the temporary agency work and the outsourcing or subcontracting of services.
Summary:
Triangular relationships are not a new phenomenon for Labor Law. Nevertheless, what can not be disregarded is the fact that over the last years triangular relationships tend to dominate the job market. It wouldn’t be an exaggeration to say that triangular relationships are to replace the “tradiotional” two-party employment- that is to say the relationship that exists between an employer and an employee.
What is questioned today is whether Labor Law which is based on the “traditional” two-party contractual agreement, can sufficiently protect the employees that participate in triangular relationships and also cover the multiple problems that occur while working.
This paper aims to demonstrate how triangular relationships work and to specify the way they are regulated in Greece, while laying emphasis on the dangers that often occur for the employees. In particular, the triangular relationships presented are: the agreement of borrowing- loaning an employee, the temporary agency work and the outsourcing or subcontracting of services.
