Summary:
The present thesis seeks to highlight the inadequacy of the existing legal framework regarding the occupation of the two-wheeled courier-distributors, to effectively protect the employees in question, who are at a daily and high risk of causing and suffering an accident while performing their work. Specifically, those elements that affect the working conditions and safety of both courier and delivery distributors are examined, while the current legislation on accidents at work and the theory on the inclusion of the profession in question, in the category of "prone to damages professions" are presented. However greater emphasis is given on the general and specific legal framework regarding the protection of the health and safety of the employees in question. The occupational risk of this field is analyzed in detail as well as the conditions that make it a profession of high risk for the health and safety of employees, while it is demonstrated that the safety of cyclists may be affected by various external conditions, such as the weather phenomena, the driving behavior of the other users of the road network, the personality of each employee, as well as the policy followed by the respective company-employer. It also summarizes the growing rise of work through platform at this field, as well as the concerns that this development entails for the labor rights of distributors. Finally, ways of preventing the occupational risks to which the employees in question are exposed are proposed with specific suggestions as far as the employers are concerned. The need to include the relevant occupation in the category of difficult and hazardous is lastly emphasized as a complementary measure.
