Summary:
The present thesis attempts to examine the interplay between European and national law in the field of damages actions for infringements of competition law. The first part of the thesis explores the doctrinal foundation of the relevant right to damages and its constituent elements based on the case-law of the Court of Justice of the European Union. At the same time, a determination of the core of the right to damages is attempted, taking into account the views of the Advocates General and the Court of Justice of the European Union. The second part of the thesis deals with the application of the damages actions at issue. On the one hand, the principle of procedural autonomy of the member states and its limits are examined. On the other hand, the rules laid down in Directive 2014/104/EU, as well as some issues not falling within its scope, are analyzed, so as to determine the level of its interference with national procedural law.
