Summary:
The main subject of the present study concerns the quest and the definition of the legal limits of secret infiltration, as the aforementioned investigation act is derived in the article 254 of the Greek CPC as well as in specific special provisions in various criminal laws. In order to draw references about the scope and the nature of the legal limits of secret infiltration, the Greek Constitution, the European Convention of Human Rights, the EU law as a whole and the Greek CPC were used as interpretive and methodological “tools”. On the second part of this subject, the reader might find a comparative analysis which examines the degree of adaptability of the Greek Legislator of the new CPC as well as of the Greek judicial system, as it expresses its thesis through its case law to the above mentioned legal limits. On the introductory part of this subject, a brief analysis is made, concerning issues such as the legal expediency of infiltration, the historical background of its legislation, the content of police - investigating infiltration in other legal orders as well as the method of distinguishing between the legal infiltration and various related concepts. In the final chapter of this subject, an examination of various aspects of potential unconstitutionality of the lawful infiltration is attempted, as well as a presentation of the casual link between the investigating act of infiltration and the modern security state policy.
