The adoption of the new Directive in 2014 signifies clearly that the field of public procurement is now imbued by new objectives such as efficiency.
In order to achieve such objectives, the E.U. designs and adopts new procurement procedures which are based on the elements of flexibility and negotiation.The new procurement procedures are: competitive dialogue, competitive procedure with negotiation and the innovation partnership.
The introduction and normalisation of a certain degree of negotiation in public procurement constitutes a potential point of friction with and divergence from the fundamental principles of public procurement.
