Summary:
The purpose of this work is to examine the relationship between Marxism and Anthropology of Law. In this context the main themes are the perspective of Marxism towards kinship and the issue of matrilineal descent. The first chapter presents the basic points of Engels’ work "The Origin of Family, Individual Property and the State". Emphasis is given to the history of the family and its evolution. The conclusions that Engels reached about private property and the state are presented in brief. The second chapter discusses some of the best-known criticisms on Morgan’s and Engels’ approach to kinship. Malinowski's critique is presented, and then follows Schneider's approach to kinship as a cultural phenomenon. This second chapter closes with examples from the field of social anthropology in which the social role of kinship is obvious. The third chapter deals with the question of whether matrilineal descent was a historical fact and also with the developments on the subject after Morgan and Engels. This chapter first presents the ideas of Franz Boas and his field research on the Kwakiutl Native American tribe, then deals with Radcliffe-Brown's article on "Mother’s Brother" and finally considers the contemporary positions of Paleoanthropology and Evolutionary Biology. The last chapter contains the final conclusions.
