Summary:
The principle of mutual trust constitutes a cornerstone of the existence and coherence of the legal union structure. The essence of the concept of mutual trust is that each Member State recognizes the common values on which the Union is founded and that each Member State trusts that the rest uphold those values within their individual national jurisdictions. The assumption that each Member State keeps a minimum level of protection of fundamental human rights, as well as that it safeguards the total of all principles of a democratic and liberal rule of law, is now strongly challenged and seriously tests the legal strength of the infrastructure of the European Union.
