The legal nature of restrictions on the free movement of capital in contemporary EU law
Summary:
This dissertation surveys the legal nature of the restrictions on the movement of capital, including the so-called "capital controls", in the European Union. The Union, through a long, controlled, and persistent process, has set out -through EU law and case law- the liberalization of capital flows, addressing any serious challenges. These efforts towards the gradual progress and the further development of the free movement of capital, which is the latest and the broadest one of the four fundamental freedoms, has resulted in a radical reform of its relevant legal framework in Europe. Taking into account the specific characteristics of the capital restrictions, but also the recent cases of their implementation -in times of crisis- in Greece and Cyprus, it is clear that, now, their imposition is neither the usual practice, as it was for many decades in the past, nor an easy way out -from a legal point of view- for the Member States. Nowadays, it is becoming obvious that any barriers preventing the free movement are in fact causing problems that affect the proper functioning of the single market and, consequently, the Union itself. However, this does not diminish the special role and usefulness of the capital restrictions, as they may be justified under certain conditions, as provided in the EU law, which allows Member States some flexibility to legally derogate from the fundamental principle of free movement of capital in exceptional cases. In any event, new aspects of the legal framework of the capital controls in the context of the contemporary EU law are highlighted, while the thorough analysis gives an accurate picture for the establishment and functioning of the free movement of capital as one of the key elements in the EU internal market. Taking into account the continuous developments of the law over the course of the European integration, at a time when “more Europe” is often questioned, this dissertation aims to contribute to the further promotion of the scientific dialogue in the field of EU law.
