Summary:
Subject of this essay is the specification and concretisation of the good faith in the interpretation of contracts and the fulfilment of contractual obligations, with special reference to the application of the aforementioned principle specifically in the area of contracts of transfer or exploitation of copyright or related rights. The essay is divided in three chapters. The first chapter focuses on the function of good faith in the process of searching the content of contractual provisions, in contracts in general and more specifically in contracts of transfer or exploitation of copyright or related rights (pursuant to article 200 of the Greek Civil Code). Subject of the second chapter is the function of the good faith in the area of the fulfilment of contractual obligations that derive from the said contractual provisions (pursuant to article 288 of the Greek Civil Code). The third chapter focuses (also taking into consideration the requirements of good faith) on the consequences on the aforementioned contractual provisions of the amendments to Directive 2006/116/EC by virtue of the provisions of subsequent Directive 2011/77/EU, taking also into account the corresponding provisions of law 2121/1993.
