The integrity of the contemporary market in financial instruments: a critical approach of the regulatory framework for market abuse
Summary:
The regulatory framework on market abuse is based on the following two-tier system of unlawful use of information within the financial instruments’ market: on the one hand, there is the unlawful use of valid information, the inside nature of which prejudices the placing of the investors on an equal footing· on the other hand, there is the unlawful production and dissemination of invalid information, the manipulative and false nature of which prejudices the ability of the investors to make their investment decisions based on reliable data.
Considering the above, the first chapter presents the historical foundations of the market abuse framework from the point of view of its economic as well as its legal aspects.
The second chapter analyses the conduct that constitutes unlawful use of inside information, which is characterised by the fact that the prejudice of market integrity is referenced to the cause of the action.
The third chapter analyses the conduct that constitutes market manipulation, which is characterised by the fact that the prejudice of market integrity is referenced to the possible result of the conduct.
