Legal Issues arising from the application of Blockchain technology; the example of Non Fungible Tokens (NFTs)
Summary:
Non Fungible Tokens (NFTs) are (i) Blockchain-based cryptographic assets, (ii) with unique identifiers and metadata that distinguish them from other cryptocurrencies, (iii) providing the ability to: linking them to physical or digital assets. The present work begins inevitably by describing both the system of Blockchain technology and the technical characteristics of the non-fungible tokens themselves, in order to analyze more clearly the legal issues that arise. In the absence of relevant legislation and case law, the existing legal tools provided by Greek and EU law are used to pose and sometimes answer questions concerning the two issues raised here: the (possible) nature of non-fungible tokens as electronic private securities that derive from private will and their direct relation to copyright law.
