Summary:
Municipalities in the European multi-level system face a variety of challenges in managing their tasks. On the one hand, they are theoretically considered active subjects within the framework of municipal self-government according to Article 28 par. 2 GG, on the other hand, and practically as recipients of instructions in the network of the European multilevel system. It is in relation to this area of tension that current developments and what trend is emerging in the course of progressive Europeanisation should be discussed. The tasks of the municipalities are regulated by the state constitutions. In Germany, only a small proportion of tasks are assumed by the federal government. Task management is therefore primarily a matter for the federal states and the municipalities. In the context of municipal government, the execution of tasks in the delegated sphere of activity plays an important role, i.e. federal and state laws are implemented by the lower administrative authority, with a presumption of municipal responsibility. Other levels of the system are only activated when working at the municipal level does not seem feasible or homogeneous solutions are required. Under indirect state administration, tasks are delegated to the demos by law, i.e. the type of task to be performed is determined and the demos receives financial compensation for this (ordering matters or guidance work). In the context of self-government issues as non-governmental tasks, a distinction must be made between voluntary tasks on the one hand, where the right to define tasks belongs to the demos itself, and compulsory tasks that are not subject to instructions, i.e. tasks that are transferred by law to the state and the demos.
