Original Title:
Το Ποινικό Δίκαιο στους Νόμους του Πλάτωνα και στην Αθήνα: η περίπτωση της ανθρωποκτονίας
Translated title:
Penal Law in Plato's Laws and in AthensQ the homicide case
Summary:
The main purpose of the essay is to give answers to some questions which come up through the comparison between the penal system for homicide in Athens and the penal system in Plato's Laws: what elements of the Athenian penal system of the 4th century BC or of earlier ages has Plato used in his Laws? What elements from the Athenian laws has neglected and why? What changes has he suggested to the Laws of Athens and which are the reasons behind these changes? Furthermore the essay tries to examine the effect of certain factors on the infliction and gradiation of the penal homicide laws' severity, such as the particularity of homicide comparing to other offences or the importance of μίασμα (miasma). The social distinctions in Athens have been also a matter of discussion in the essay. The essay also tries to enlight the changes in the Athenian laws which Plato suggested and by which he established the rules of his ideal "politeia" and the political, philosophical and legal reasons that led him to suggest these changes
