Summary:
The issue of the privacy of public figures expresses the conflict between the right to privacy and the right to freedom of expression. How does one balance the right to privacy of a public figure against freedom of expression? The scope of protection and limitations of these rights will be the subject of the first chapter. As a general rule, freedom of expression cannot be exercised at the expense of the right to privacy. The issue becomes more complicated, however, when the holder of the right to privacy is not a private individual but a public figure. The second chapter will provide a detailed definition of the notion of public figures, highlight some specific aspects of the issue as well as examine the terms and conditions that may possibly lead to a reduction in the protection of privacy of public figures, since the classification of a person as a public figure does not in itself entail an affirmation of the reduction of the protection they are entitled to. At the same time, other criteria must be met and other circumstances must be taken into account. The third chapter of this paper will show that the Constitution still protects the privacy of public figures. However, the limits of the scope of the enjoyment of the two conflicting rights are redefined and differentiated from those generally applicable. The purpose of this chapter will be to seek a field of absolute and irrefutable protection of privacy, even for public figures. Thus, the question raised earlier is broken down into several sub-questions. Who are public figures, when and under what circumstances is the protection of their private life curtailed and when is it preserved intact?
