Summary:
The present study is an outline of a delicate but intricate issue: who is a Citizen and especially a Greek Citizen. The importance of scientific engagement with the status of Citizen is concentrated in the fact that being one, is considered as an active status of the subject of the law. The stakes are, among other things, to be found in the balances of power between an inherently organizational and interventionist formation, such as the state, and the legal subject which is self-determined, heteronomous and actively decides. It is not, however, a perpetual struggle of resistance and endurance, as long as we consider that the institutions themselves are not one-dimensional. Starting from these assumptions and with the search and questioning as its most valuable tool, this essay structurally consists firstly of a brief historical review of citizenship. Then, the emphasis is placed on the dual approach of citizenship either through the constitutional or legislative texts, followed by conceptual clarifications of relevant definitions and the elaboration of the basic principles of citizenship law. Finally, the technical and practical part is presented, i.e. how one acquires the status of a Greek Citizen and its consequences. Of course, the two fundamental decisions of the Greek Council of State, on the matter, are discussed. In conclusion, it is sought whether the everlasting and dynamic character of the Constitution is also transfused in the definition of the Greek Citizen, through adaptability and what rules and demands it obeys, whether there are legal barriers, conceptual constants and who was, is and will be a Greek Citizen.
