Summary:
The main object of this presentation is to shed light on the coverage of the social security risk of disability.
In this context, on the one hand, will be attempted an overview of the concept and causes of disability,the procedure and conditions for disability retirement,the amount of the pension, as well as some critical issues at the national level, regarding the duration of retirement. On the other hand, the provisions at the Union level and the consideration of disability pensions by the Eurorean Court of Human Rights ( ECHR) will be sought , with the final goal of a critical assessment of the operation of the modern social security edifice.
The analysis that will follow was triggered by the thought that, at any time, a person could become disabled.In turn, disability constitutes a risk,recognised as worthy of social security protection,in the person of every employee.In fact, it is worth emphasizing in advance that social security is interested in the problem of disability and fulfills its protective role,provided that the disability has an impact to the earning capacity of the employee, the related to his professional activity,the demands of the labour market,his education, skills and even his age.
After all, the primary purpose of the benefits, awarded in the context of social security system,is to replace the lost income from work, that the disabled cannot exercise, because he lost his physical, mental or pshycological integrity.
