Summary:
How to draw the line between European law and the constitutional law of the Member States is one of the most controversial issues in the field of European public law, often known as European constitutionalism. Due to the transfer of essential authorities from Member States to the Union, European Union membership has delivered a significant blow to state sovereignty. As a result of the principles of direct applicability and primacy of the EU’s overall rules of the national legal orders of the Member States, the fundamen-tal principles of the legal order in each Member State have been called into question, and sovereign national dogmas that have been in effect for years have been overturned, caus-ing uncertainty and provoking reactions within them. Since the early years of the Com-munity, when doubts were first raised about the principle of primacy over the national constitution, particularly in regard to the safeguarding of national fundamental rights, the national constitutional courts have played the most significant role in this respect. This thesis investigates the historical evolution of the connection between EU law and the constitutional law of the Member States, as indicated by the Court of Justice's judgments and the institutional requirements of the Treaties.
