The reduction of pollution of the marine environment in the context of the UN Sustainable Development Goal 14 for 2030: Issues of Public and Private International Law
Summary:
This paper, at a first level, maps the available instruments of both international and private international law against marine degradation, in particular with regard to transboundary pollution. Furthermore, it aspires to explore the potential of private international law to address existing disconnections in the law in a way that facilitates local communities, which are more dependent on the sea, to address violations that affect their maritime space. This will allow these communities, which are cradles of largely unrecognised ocean values, to address issues against more powerful, commercial, maritime actors (for example, the extractive industry). It will also put them in a position to harness and share equitably the environmental and socio-economic benefits of sustainable use of the seas.
